Maybe leave it planted and buy a second one as well? There isn't much point in ripping out the plant but i think adding extra soil will kill the tree.

I would clear the mulch right away from the trunk of the tree or it would get collar rot. Otherwise it should be ok. Need to see the rest of the tree to see if it's in trouble.

would this bend cause problems though when its much larger , as I live on a fairly windy block. The tree is growing fine, slow but fine. If I placed more soil around the bottom would it possible send out more roots or just rot?

I wouldn't put soil around the base of a tree trunk in case it causes collar rot. However, if you insist, then I would marcott it at the base and perhaps roots will grow from the wound. Alternately marcotting it elsewhere will give you the same age tree, then you can replace it with the new one. Otherwise, just rip it out and start again.

It looks like it was rootbound with roots circling around a pot before planting. They can self strangle with age and root thickening but usually don't.It should be ok especially if it still sent a taproot down but might need a stake for a while yet.
